Palembang, The Indonesia Post – The Draft Regional Regulation (Raperda) public test activity on the preservation of clan cultural values in society was organized by the Regional Regulations Establishment Agency (Bapemperda)Legislative Council (DPRD) Prov. South Sumatra is an initiative proposed by the Provincial DPRD. South Sumatra and has been included in the Prov. South Sumatra.
This public test was carried out in the budget body of the DPRD Prov. South Sumatra and was opened directly by the Chairperson of the DPRD Prov. Sumsel Hj. RA. Anita Noeringhati, SH. MH ( Monday, October 31, 2022 ).
In her speech, the chairman of the DPRD stated that at that time the clan was a system of government as well as a custom and culture that was unique to South Sumatra and became one of the local wisdoms even long before independence. The clan received recognition in the 1945 Constitution as stated in the explanation, before the Constitution was amended.
The formation of the clan itself refers to the Simbur Cahaya Law which is a codification of the legal provisions of the Palembang Darussalam Sultanate since the seventeenth (seventeenth) century. The existence of clans has colored the legal system of government and social system which is deeply ingrained and developed into clan culture.
Since the enactment of Law No. 5/1979 concerning village governance, there has been a conversion of clans into the village structure which is a model of community organization according to the Javanese system. The conversion then also resulted in the destruction of identity, local leadership, customary autonomy, and patterns of social relations at the clan level. The clan that used to grow and develop with unique local wisdom and supported by various institutional and power tools was transformed into a monotonous village.
With the Decree of the Governor of South Sumatra No. 142/KTPS/III/1983 concerning the Abolition of the Marga System, the identity of indigenous peoples has been forcibly revoked.
Today there are many demands from society to re-implement clan customs in society. The South Sumatra DPRD welcomed this and tried to formulate a regional regulation as a legal umbrella for its application in the regions, however the South Sumatra DPRD through BAPEMPERDA did so with the precautionary principle that it should not conflict with the applicable laws and regulations.
Chairman of Bapemerda DPRD Prov. South Sumatra H. Toyeb Rakembang in his speech also stated that this activity was carried out based on the provisions of Article 58 of Law Number 15 of 2019 concerning Amendments to Law Number 12 of 2011 concerning the Establishment of Legislation.
The purpose of holding this public test is to obtain input in the preparation and improvement of the Draft Regional Regulation on the Preservation of Clan Cultural Values in society so that it is more comprehensive and in accordance with the philosophical, sociological and juridical foundations. The mission that we carry in the formation of this Raperda is the identification of clan cultural values that are still possible to be revived so that the local wisdom of the people of South Sumatra from various perspectives related to the existence of clans since hundreds of years ago will be crystallized in the culture of the people of South Sumatra and have an impact on social resilience. society from the bad influence of outside culture.
The implementation of the Public Test presents resource persons from academics and competent figures from various disciplines and experiences related to clan cultural values, namely: DR. Tarech Rashid, DR. Meita Istiadi, DR. Lur Bahrul Ilmi Yakub, DR. Dedi Irwanto and H. Nang Ali Solichin, SH with the participants of the relevant OPD heads, Expert Team/Expert group of the South Sumatra Provincial DPRD and the Head of the Legal Division of the Regency/City Secretariat.
