Holding a Joint FGD with the Palembang District Attorney’s Office, Palembang City Council Discusses Legal Risk Mitigation in Procurement

Palembang, The Indonesia Post – The Palembang City Council (DPRD) Secretariat held a Focus Group Discussion (FGD) with the Palembang District Attorney’s Office to educate and provide legal assistance regarding legal risk mitigation in every procurement process.

The event, which featured the Head of the Civil and State Administration Section of the Palembang District Attorney’s Office and staff, aimed to improve the DPRD Secretariat’s understanding of the legal aspects of government procurement of goods and services.

The Secretary of the Palembang City DPRD, Rediyan Deddy Umrien, in his presentation stated that procurement of goods and services is a strategic activity that plays a crucial role in supporting the smooth implementation of the DPRD’s duties and functions. However, each procurement stage carries potential legal risks if not implemented in accordance with applicable laws and regulations.

He stated that a good understanding of procurement regulations and procedures is crucial for officials to minimize administrative errors and potential legal violations. Therefore, this FGD serves as an important tool for strengthening understanding and building coordination with law enforcement officials.

“Through this activity, it is hoped that the DPRD Secretariat staff will gain a better understanding of the legal aspects of goods and services procurement, so that each process can be carried out professionally, transparently, and accountably,” he said.

The discussion also explained various procurement stages that have the potential to give rise to legal risks, from procurement planning and preparation, supplier selection, contract execution, and the handover process.

Furthermore, several forms of legal risks that frequently occur in the procurement process were highlighted, including the preparation of technical specifications that favor certain suppliers, the preparation of unreasonable Self-Estimated Prices (HPS), supplier selection processes that do not comply with procedures, and work execution that does not comply with contract provisions.

Through this forum, the Palembang District Attorney’s Office also provided an understanding of the role of legal assistance, such as providing legal opinions, legal consultations related to procurement, and assistance during the implementation of activities as a preventative measure against potential legal issues from the early stages.

This FGD is expected to foster stronger synergy between the Palembang City Council Secretariat and the Palembang District Attorney’s Office, ensuring more orderly, transparent, and regulatory-compliant government procurement.

Similar activities are expected to continue in the future as part of efforts to increase the capacity of government officials and strengthen the oversight and prevention system in managing government finances and activities. (rys/ril)
